1. Purpose

These TCS govern the contractual relationship between Tougouchev Igor – Sole Proprietorship (EI) (operating the site under the non-registered name "TOURSEKEV") and any non-professional natural person wishing to purchase via the website.

2. Minimum age

The products offered are reserved for persons aged 18 or over. By confirming their order, the buyer certifies that they are of legal age.

3. Products

  • Descriptions, photos, and characteristics are provided for information purposes only; minor variations may occur.
  • Products are offered while stocks last.
  • Customized or digital products, where applicable, are neither returnable nor exchangeable, except in the case of a major defect.

4. Prices

  • Prices are in euros (€), including taxes if applicable.
  • Shipping fees are specified before order confirmation.
  • VAT exemption – Article 293 B of the CGI.

5. Orders

  • Order confirmation implies acceptance of the TCS.
  • A confirmation is sent by email after payment is received.

6. Payment

  • Secure payment via Shopify Payments or associated service providers.
  • Accepted methods: credit card, others depending on availability.
  • In case of fraud or payment refusal, the order may be cancelled.

7. Delivery

  • Delivery to France, Europe, USA, Canada, and other countries available at the time of the order.
  • We reserve the right to cancel an order if delivery is impossible, too costly, or prohibited (e.g., force majeure, geopolitical restrictions).
  • Delivery times are provided for information purposes only.
  • Risk is transferred to the customer once the parcel is handed over to the carrier.

8. Right of withdrawal

  • 14-day period to change your mind without justification.
  • The customer must return the products within an additional 14 days.
  • Return shipping costs are the responsibility of the customer.
  • Returned product: clean, unused, complete, and well protected.
  • Exceptions: customized, digital, or opened/used products.

9. Legal warranties

  • Conformity: Articles L217-3 to L217-20 of the French Consumer Code.
  • Hidden defects: Articles 1641 to 1649 of the French Civil Code.

10. Responsibilities

  • We disclaim all liability in case of product misuse or force majeure (e.g., strike, weather, etc.).
  • Products may not be resold for commercial purposes without authorization.

11. Website suspension or closure

We reserve the right to modify, suspend, or permanently close the store without notice, if necessary (e.g., maintenance, temporary or permanent shutdown).

12. Personal data

  • In accordance with the GDPR (EU 2016/679).
  • Right of access, rectification, objection, deletion: the privacy policy is available at the bottom of the page.

13. Governing law – Disputes

These TCS are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
Failing that, the courts of Dijon (21) or the customer’s place of residence will have jurisdiction.

14. Contract language

The TCS are written in French. In case of any discrepancy between a translated version and the French version, the latter shall prevail.
