<h2>🔐 GDPR Notice – Invoicing & Communications</h2>
<p><strong>Last update:</strong> 7 December 2025</p>
<p><strong>Data controller:</strong> Tougouchev Igor – EI, operating under the non-registered trade name “TOURSEKEV”, 3 avenue Albert 1er, 21000 Dijon, France – <a href="mailto:toursekev@gmail.com">toursekev@gmail.com</a></p>
<h3>1) Invoicing via Simplio Invoice (Shopify integration)</h3>
<ul>
<li><strong>Roles:</strong> TOURSEKEV is the <em>data controller</em>. Simplio (application “Simplio / Simple Invoice”) and Shopify act as <em>processors</em>.</li>
<li><strong>Source & categories of data:</strong> order data coming from Shopify (identity, contact details, delivery/billing address, order references, product line items).</li>
<li><strong>Processing method as declared by the provider:</strong> invoices are generated <em>on the fly</em> via the Shopify API, with <strong>no storage</strong> of customers’ personal data by Simplio; only <strong>anonymised</strong> technical logs are kept (e.g. error codes, timestamps).</li>
<li><strong>Location & transfers:</strong> processing is carried out within Shopify’s infrastructure (servers notably in the United States and other jurisdictions). Transfers outside the EEA rely on <em>Standard Contractual Clauses</em> and Shopify’s list of subprocessors.</li>
<li><strong>Legal bases:</strong> performance of the contract/pre-contractual measures (art. 6-1-b RGPD) and legal obligations relating to invoicing/accounting (art. 6-1-c).</li>
<li><strong>Retention periods:</strong> Simplio carries out <strong>no retention</strong> of customer data. <strong>Invoices</strong> are retained by TOURSEKEV for <strong>10 years</strong> (tax obligations). Customer accounts/data are retained for up to <strong>5 years</strong> of inactivity (see §9 of the CGS).</li>
<li><strong>Incident notification:</strong> in the event of an incident notified by Shopify/Simplio that may affect your data, we will inform you <strong>within 72 hours</strong> after becoming aware of it, in accordance with the RGPD.</li>
</ul>
<p><small>This summary is based on the information provided by Simplio. We will update this section if the provider declares any changes.</small></p>
<h3>2) Customer communication channels (emails & messages)</h3>
<ul>
<li><strong>Services used:</strong> Gmail (Google), Shopify messaging/notifications, and, where applicable, <strong>Squarespace</strong> for <em>email redirection</em>.</li>
<li><strong>Role:</strong> these providers act as <em>processors</em> for routing, hosting and delivering communications.</li>
<li><strong>Data processed:</strong> email address, first/last name if provided, message content, attachments, technical metadata (timestamp, headers, security elements; possibly IP address depending on the provider).</li>
<li><strong>Legal bases:</strong> performance of the contract/pre-contractual measures (art. 6-1-b) and <strong>legitimate interest</strong> in replying and providing support (art. 6-1-f).</li>
<li><strong>Transfers:</strong> these services may process data outside the EEA; transfers rely on appropriate safeguards (Standard Contractual Clauses or equivalent mechanisms published by each provider).</li>
<li><strong>Retention:</strong> for as long as necessary to process the request and ensure support traceability, then legal archiving where applicable.</li>
</ul>
<p><strong>Document hierarchy:</strong> the <em>Privacy Policy</em> provided by Shopify (displayed at the bottom of the page) <strong>prevails</strong> over any provision relating to personal data contained in these CGS. In case of inconsistency, the Privacy Policy shall prevail.</p>
<p>For all your <strong>RGPD rights</strong> (access, rectification, erasure, restriction, objection, portability) and contact details, please refer to <strong>§9 – Personal data</strong> below.</p>
<h3>Customer reviews – Judge.me (RGPD)</h3>
<p>Customer reviews are collected and displayed via the <strong>Judge.me Reviews</strong> application, acting as a <strong>processor</strong> on behalf of <strong>TOURSEKEV (Tougouchev Igor – EI)</strong>.</p>
<p><strong>Data that may be processed:</strong><br>first name or nickname, email address, IP address, rating, review content, related product, technical browsing data.</p>
<p><strong>Purpose of processing:</strong><br>collection, display, verification of authenticity and improvement of customer reviews.</p>
<p>Judge.me has <strong>technical access to orders</strong> in order to verify reviews, in line with checks performed by Shopify.</p>
<p><strong>Transfers outside the European Union:</strong><br>where applicable, they rely on <strong>appropriate safeguards</strong>, in particular <strong>Standard Contractual Clauses (RGPD)</strong>.</p>

<p>Access to the website is restricted to persons of legal age under the laws of their country of residence. By confirming an order, you certify that you are a legally responsible person. Purchases are prohibited for persons under guardianship or subject to a recognised legal incapacity.</p>

<li><strong>Professionals</strong>: we do not offer professional cooperation (resale, distribution, wholesale, etc.).</li>
<li><strong>Electronic evidence</strong>: automatic records (payment, Shopify confirmations, emails) constitute evidence between the parties.</li>
<li><strong>Hierarchy:</strong> in the event of conflict, Shopify’s Privacy Policy prevails for personal data.</li>

<li>Limited stock – subject to availability at the time of ordering.</li>
<li>Custom or digital products: no return or exchange, except in case of proven defect.</li>

<li>Displayed in euros (€), VAT not applicable (article 293 B of the CGI).</li>
<li>Excluding shipping costs, customs duties or other fees depending on the destination.</li>

<li>Order confirmation implies acceptance of these CGS.</li>
<li>Confirmation is automatically sent by email after payment.</li>
<li>We reserve the right to cancel any order at our sole discretion, without obligation to provide justification (suspected abuse, fraud risk, unavailability, country restrictions).</li>

<h3 id="cgs-7">7. Payment & Invoicing</h3>
<ul>
<li>Secure payment via Shopify Payments and any other methods available on the website.</li>
<li>You certify that you are authorised to use the selected payment method.</li>
<li>The invoice is generated automatically once the payment has been validated.</li>
<li><strong>No telephone support is provided</strong>, even if a phone number is displayed. All communication is via Gmail/Shopify/Squarespace redirection (see GDPR Notice).</li>

<h3 id="cgs-8">8. Delivery – Customs – Transfer of risk</h3>
<ul>
<li>Delivery available to France, the European Union, the USA, Canada, and other countries depending on availability.</li>
<li>We reserve the right to refuse shipment if it becomes impossible or too risky (logistical, climatic or political reasons).</li>
<li>Delivery times are provided for information only.</li>
<li><strong>Transfer of risk</strong>: upon handing over the parcel to the carrier. The Customer must issue specific reservations to the carrier in case of damage/loss.</li>
<li><strong>De facto importer</strong>: the Customer is responsible for import formalities and costs (duties, taxes, customs clearance) and for complying with local laws.</li>
</ul>
<h3 id="cgs-9">9. Right of withdrawal and returns</h3>

<h3 id="cgs-10">10. Personal data – Provisions specific to TOURSEKEV</h3>
<p>Personal data are processed in accordance with the General Data Protection Regulation (RGPD – EU 2016/679) and the automated Privacy Policy available at the bottom of the page. In addition, the following provisions apply specifically to the operation of the TOURSEKEV website and online shop:</p>
<ul>
<li><strong>Legal identity:</strong> Data are processed by <strong>Tougouchev Igor – EI</strong>, operating under the <strong>non-registered trade name “TOURSEKEV”</strong>. This trade name is not a registered trademark and does not constitute a company name (dénomination sociale).</li>
<li><strong>No third-party tracking:</strong> No third-party pixels or tracking tools (Google, Meta, etc.) are installed. Only cookies integrated into Shopify are used, with a consent banner available at the bottom of the page.</li>
<li><strong>Invoicing:</strong> Invoices are issued via the <em>Simple Invoice</em> service. The data required for invoicing are transmitted to this provider.</li>
<li><strong>Shipping providers:</strong> Data required for shipping (name, address, email, phone number) may be transmitted to various carriers in France or internationally, depending on logistical constraints. In France, Colissimo or Mondial Relay may be used, without exclusivity.</li>
<li><strong>Retention periods:</strong>
<ul>
<li>5 years after the customer’s last activity (order, login) for accounts and associated data.</li>
<li>10 years for documents relating to invoicing, in accordance with tax obligations.</li>
<li>Certain data may be retained temporarily after deletion for legal or security reasons.</li>
</ul>
</li>
<li><strong>Account deletion:</strong> We reserve the right to delete a customer account without prior notice in the event of abusive use, fraud, suspicious activity or breach of the General Terms. Inactive accounts may also be deleted after a period deemed no longer necessary, in line with CNIL recommendations.</li>
<li><strong>Minors:</strong> Access to the website and the purchase of products are prohibited for persons who are minors under the laws of their country of residence. We do not knowingly collect data relating to minors.</li>
<li><strong>Your rights:</strong> Right of access, rectification, erasure (“right to be forgotten”), objection, restriction, portability, withdrawal of consent. Any request may require proof of identity.</li>

<li>Resale without prior authorisation is prohibited. We reserve the right to cancel any suspicious or abusive order.</li>

<li>No liability is accepted in case of misuse, handling errors or force majeure (bad weather, strikes, etc.).</li>
<li>We do not guarantee uninterrupted or error-free service; any total liability, where applicable, is limited to the amount of the relevant order.</li>

<h3 id="cgs-13">13. Fraud prevention – Account security</h3>
<ul>
<li>We may carry out checks (payment, address, identity) and cancel or put an order on hold in case of doubt.</li>
<li>The Customer is responsible for keeping their login details confidential and for access to their account.</li>

<h3 id="cgs-14">14. Suspension/termination of the service – Maintenance</h3>
<p>We may modify, suspend or close the website without prior notice for technical or business reasons.</p>
<p>Temporary closure periods may occur (maintenance, holidays or prolonged absence). In such cases, an information message will be displayed on the website. Processing and response times may be longer during these periods.</p>
<h3 id="cgs-15">15. Governing law – Dispute resolution</h3>
<p>This contract is governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, jurisdiction is given to the courts of Dijon (21) or to the court of the customer’s place of residence.</p>
<p><small>In accordance with art. L.616-2 of the French Consumer Code (Code de la consommation) and art. 14 of Regulation (EU) No 524/2013, the consumer may use the European online dispute resolution platform (RLL/ODR). Information on the competent mediation body will be provided to the customer where mediation is applicable.</small></p>
<h3 id="cgs-16">16. Contract language</h3>
<p>The French version of the CGS is legally binding, even where translations are available on the website.</p>
